Probleminiai proporcingumo principo užtikrinimo aspektai, taikant slaptus ikiteisminio tyrimo veiksmus

Siekiant išnagrinėti probleminius klausimus, susijusius su proporcingumo principo užtikrinimu, taikant slaptus ikiteisminio tyrimo veiksmus, buvo analizuojami: proporcingumo principas ir jo reikšmė procesinių prievartos priemonių taikyme; slaptų ikiteisminio tyrimo veiksmų teisinis reglamentavimas, su tuo susijusi nuo 2015 m. iki 2026 m. kasacinio teismo praktika bei atlikto interviu metu su ikiteisminio tyrimo teisėjais gauti atsakymai; dviejų didžiausių Lietuvos apylinkės teismų slaptų ikiteisminio tyrimo veiksmų sankcionavimo statistika. Darbe nustatyta, kad proporcingumo principo neaiškus turinio apibrėžimas ir neaiškūs jo taikymo (ir vertinimo) kriterijai yra vienas iš proporcingumo principo užtikrinimo probleminių aspektų, taikant slaptus ikiteisminio tyrimo veiksmus. Ši problematika kartu su įstatymų leidėjo paliktomis spragomis aktualiuose BPK straipsniuose suteikia teisėjams plačią diskreciją spręsti, ar tam tikras slaptas ikiteisminio tyrimo veiksmas gali būti taikomas. Nurodytos aplinkybės gali lemti skirtingos praktikos formavimąsi. Kasacinio teismo nutarčių ir ikiteisminio tyrimo teisėjų interviu atsakymų analizė leidžia teigti, kad teismai iš esmės sėkmingai užpildo įstatymų leidėjo paliktas spragas. Kita vertus, atsižvelgus į šių veiksmų taikymo gana didelį mastą, į tai, kad jie labiausiai varžo asmens teises ir laisves, manytina, jog įstatymų leidėjas turėtų užpildyti bent dalį esminių spragų.
In order to examine the issues related to ensuring the principle of proportionality when applying covert pre-trial investigation measures, the following were analyzed: the principle of proportionality and its significance in the application of procedural coercive measures; the legal regulation of covert pre-trial investigation measures, the relevant case law of the Supreme Court from 2015 to 2026, and the responses obtained during interviews with pre-trial investigation judges; statistics on the authorization of covert pre-trial investigation measures by the two largest district courts in Lithuania. The study found that the vague definition of the principle of proportionality and the unclear criteria for its application are among the problematic aspects of ensuring the principle of proportionality when conducting covert pre-trial investigation activities. This issue, combined with the gaps left by the legislature in the relevant articles of the Code of Criminal Procedure, grants judges broad discretion to determine whether a particular covert pre-trial investigation measure may be applied. These circumstances may lead to the development of divergent practices. An analysis of Supreme Court rulings and the responses of interview participants suggests that the courts are generally successful in filling the gaps left by the legislature. On the other hand, given the relatively large scale of the application of these measures and the fact that they most severely restrict a person’s rights and freedoms, it is reasonable to conclude that the legislature should fill at least some of the significant gaps.
