Darbo aktualumas pasižymi, tuo kad baudžiamojoje teisėje trūksta naujo požiūrio į nullum crimen sine lege principo taikymą baudžiamojoje teisėje, dėl kylančios prieštaringos teismų praktikos. Darbo tikslas: Nustatyti nullum crimen sine lege principo reikšmę baudžiamojoje teisėje bei išanalizuoti principo teorinius aspektus ir atskleisti taikymą praktikoje. Tyrimo objektas - nullum crimen sine lege principo taikymas. Siekiant atskleisti naują požiūrį į temą buvo nustatyti 4 darbo uždaviniai: nustatyti principo kilmę; apibrėžti principo sampratą; atskleisti principo taikymo ypatumus; atlikti principo naudojimo praktikoje analizę. Siekiant atskleisti temos problemą buvo analizuojama ir pateikiama informacija, turinti reikšmingos informacijos problemai išspręsti. Magistro baigiamąjį darbą sudaro: santrumpų sąrašas, schemų sąrašas, įvadas, dėstomoji dalis, kurią sudaro trys skyriai, išvados, santrauka lietuvių ir anglų kalbomis, naudotos literatūros sąrašas ir patvirtinimas apie darbo savarankiškumą. Pirmajame skyriuje siekiama išsisaikinti principo kilmę ir sampratą. Antrame skyriuje siekiama nustatyti principo taikymo sąlygas ir išimtis. Trečiame skyriuje yra analizuojamos EŽTT bylos prieš Lietuvą. Nustatoma kokios bylos yra prieštaringos ir kokia to priežastis. Šių skyrių dėka siekiama atskleisti temą ir išspręsti problemą kodėl EŽTT bylų teismų praktika yra prieštaringa nullum crimen sine lege principo atžvilgiu. Atlikus išsamią analizę, buvo nustatyta, kad bylų prieštaringumas atsirado dėl to, kad Lietuvos teismai, partizanų sąvokos išsaikinimą pateikė neišsamų, ko pasėkoje sąvoka atrodė neatitinkanti visuomenės dalies, kurios naikinimas gali būti prilyginamas genocidui. Dėl šios priežastie EŽTT byla Vasiliauskas prieš Lietuvą, buvo prieštaringa kitų panašių faktinių aplinkybių turinčių bylų sprendimams. Šiame darbe buvo naudoti bendrieji tyrimo metodai: mokslinės literatūros analizė, lyginamais teisinis, loginis, istorinis požiūris, sisteminė analizė, bylų lyginamoji analizė.
The relevance of the work is characterized by the fact that criminal law lacks a new approach to the application of the nullum crimen sine lege principle in criminal law, due to the emerging contradictory judicial practice. The purpose of the work: to determine the significance of the nullum crimen sine lege principle in criminal law and to analyze the theoretical aspects of the principle and reveal its application in practice. The subject of the investigation is the application of the nullum crimen sine lege principle. In order to reveal a new approach to the topic, 4 tasks were set: to determine the origin of the principle; define the concept of principle; reveal the peculiarities of the application of the principle; perform an analysis of the principle's use in practice. In order to reveal the problem of the topic, information containing significant information to solve the problem was analyzed and presented. The master's thesis consists of: list of abbreviations, list of schemes, introduction, teaching part, which consists of three chapters, conclusions, summary in Lithuanian and English, list of used literature and confirmation about the independence of the work. The first chapter aims to explain the origin and concept of the principle. The second chapter aims to determine the conditions and exceptions to the application of the principle. The third chapter analyzes the ECHR cases against Lithuania. It is determined which cases are controversial and what is the reason for this. Thanks to these chapters, the aim is to reveal the topic and solve the problem of why the case law of the ECHR is contradictory regarding the nullum crimen sine lege principle. After a detailed analysis, it was found that the controversy of the cases arose because the Lithuanian courts provided an incomplete definition of the concept of partisans, as a result of which the concept seemed inconsistent with a part of society whose destruction can be equated with genocide. For this reason, the ECHR case Vasiliauskas against Lithuania was contradictory to the decisions of other cases with similar factual circumstances. General research methods were used in this work: analysis of scientific literature, comparative legal, logical, historical approach, systematic analysis, comparative analysis of cases.
