Baigiamajame darbe kristalizuoti pagrindinius SLAPP požymiai, kurie svarbūs norint atskirti pažeistų teisių gynimo ir piktnaudžiavimo procesinėmis teisėmis institutus. Tyrimo tikslas yra ištirti strateginių ieškinių dėl visuomenės dalyvavimo (SLAPP) reiškinį. Darbe keliama problema, ar LR CPK 951 str. pakankamai užtikrina apsaugą nuo SLAPP ieškinių, nepažeidžiant konstitucinės žmogaus teisės kreiptis į teismą? Daroma išvada, jog SLAPP ieškiniai nėra skirti realiam pažeistų teisių gynimui, o priešingai - naudojami kaip priemonė daryti spaudimą žiniasklaidai, aktyvistams ar kitiems viešojo intereso dalyviams. Toks SLAPP ieškinių pobūdis iškraipo civilinio proceso paskirtį ir prieštarauja jo tikslui - sąžiningai ir efektyviai spręsti teisinius ginčus. Nors Lietuvos teisėje jau yra įtvirtintos specialios kovos su SLAPP ieškiniais normos, praktinis jų taikymas nėra pakankamai aiškus ir nuoseklus - egzistuoja neapibrėžtumas, vieningos teismų praktikos stoka ir sunkumai ankstyvoje stadijoje identifikuoti SLAPP bylas.
The final thesis crystallizes the main features of SLAPP, which are important in order to distinguish between the institutes of protection of violated rights and abuse of procedural rights. The aim of this thesis is to investigate the phenomenon of strategic lawsuits for public participation (SLAPP). The thesis puts forward the problem of whether Article 951 of the Civil Procedure Code of the Republic of Lithuania sufficiently ensures protection against SLAPP lawsuits without violating the constitutional human right to apply to court? It is concluded that SLAPP lawsuits are not intended for the real protection of violated rights, but on the contrary - are used as a means to put pressure on the media, activists or other participants in the public interest. Such a nature of SLAPP lawsuits distorts the purpose of civil proceedings and contradicts its goal - to resolve legal disputes fairly and effectively. Although Lithuanian law already contains special norms for combating SLAPP lawsuits, their practical application is not sufficiently clear and consistent - there is uncertainty, a lack of uniform case law and difficulties in identifying SLAPP cases at an early stage.
