Šio magistro darbo tikslas įvertinti Europos ir Lietuvos teismų praktiką, susijusią su asmens duomenų apsauga darbo santykiuose, atskleidžiant pagrindines teisines problemas ir jų sprendimo tendencijas. Kadangi teisės aktai neapibrėžia, kaip turėtų būti vertinamas asmens duomenų tvarkymo proporcingumas vykdant darbuotojų stebėseną, teismų išaiškinimai šiuo klausimu yra itin svarbūs. Europos Žmogaus Teisių Teismas byloje Barbulescu prieš Rumuniją suformavo proporcingumo vertinimo kriterijus, taikomus iki šios dienos. Vis dėlto stebėsenos proporcingumo įsivertinimui yra svarbūs ne tik minėti kriterijai, bet ir visos konkretaus atvejo aplinkybės. Pavyzdžiui, išankstinio informavimo apie vykdomą stebėseną ir jos apimtį kriterijus tam tikrais atvejais gali būti netaikomas, jei pasirinktos priemonės, tokios kaip slaptas vaizdo stebėjimas ar garso įrašymas, buvo taikomos nepažeidžiant įstatymų ir esant pagrįstiems įtarimams dėl pažeidimų. Taigi, vertinant darbuotojų stebėsenos proporcingumą būtina atsižvelgti ne tik į proporcingumo vertinimo kriterijus, bet ir į darbdavio ir darbuotojo interesus bei jų pusiausvyrą.
The aim of this master’s thesis is to evaluate the case law of European and Lithuanian courts related to the protection of personal data in employment relationships, revealing the main legal issues and trends in their resolution. Since legal acts do not define how the proportionality of personal data processing should be assessed when carrying out employee surveillance, judicial interpretations on this issue are particularly important. In the case of Bărbulescu v. Romania, the European Court of Human Rights established criteria for assessing proportionality that continue to be applied to this day. Nevertheless, not only these criteria are important in assessing the proportionality of surveillance, but also all the circumstances of the specific case. For example, the criterion of prior notification regarding the surveillance being carried out and its scope may, in certain cases, not be applicable if the chosen measures, such as covert video surveillance or audio recording, were implemented lawfully and based on reasonable suspicions of misconduct. Therefore, when assessing the proportionality of employee surveillance, it is necessary to consider not only the proportionality assessment criteria, but also the interests of both the employer and the employee, as well as the balance between them.
