Šiame magistro darbe analizuojamas vaiko teisės būti išklausytam įgyvendinimas šeimos mediacijos procese, ypatingą dėmesį skiriant vaiką įtraukiančiai mediacijai. Darbe nagrinėjamas tarptautinis ir nacionalinis teisinis reguliavimas, įtvirtinantis vaiko teisę būti išklausytam, bei vertinama šios teisės realizavimo praktika nacionaliniu ir tarptautiniu mastu. Atskleidžiama, kad vaiką įtraukianti mediacija sudaro prielaidas geriau atliepti vaiko interesus ir priimti tvaresnius sprendimus šeimos ginčuose, tačiau praktikoje jos taikymas susiduria su reikšmingais iššūkiais. Darbe daroma išvada, kad siekiant efektyvaus vaiko teisės būti išklausytam įgyvendinimo, būtina stiprinti mediatorių specializaciją, parengti aiškias vaiko nuomonės išklausymo gaires bei didinti valstybės finansavimą mediacijai. Pateikiamos rekomendacijos, orientuotos į mediacijos proceso kokybės gerinimą ir vaiko interesų apsaugos stiprinimą.
This master’s thesis analyzes the implementation of the child’s right to be heard in the process of family mediation, with particular attention given to child-inclusive mediation. The paper examines international and national legal frameworks that establish the child’s right to be heard and evaluates the practice of implementing this right at both national and international levels. It reveals that child-inclusive mediation creates conditions for better addressing the child’s interests and for reaching more sustainable decisions in family disputes; however, in practice, its application faces significant challenges. The thesis concludes that, in order to ensure the effective implementation of the child’s right to be heard, it is necessary to strengthen mediators’ specialization, develop clear guidelines for hearing the child’s opinion, and increase state funding for mediation. Recommendations are provided, aimed at improving the quality of the mediation process and strengthening the protection of the child’s interests.
