Šio magistro baigiamojo darbo tema – „Duomenų gautų iš atvirųjų informacijos šaltinių panaudojimo problematika“. Šiuolaikinėje visuomenėje, sparčiai augant viešai prieinamos informacijos kiekiui internete, ypač tokiuose kaip tinklaraščiai ir socialinių tinklų svetainės, teisėsaugos institucijoms atvirieji informacijos šaltiniai tampa patrauklia priemone rinkti svarbius duomenis tiek tiriant nusikalstamas veikas, tiek užfiksuojant pačias veikas ir jų pėdsakus būtent interneto platybėse. Visgi, nors duomenys gauti iš atvirųjų informacijos šaltinių gali padėti atskleisti svarbias faktines aplinkybes byloje, teisminiame bylų nagrinėjime įrodinėjimo procese šie duomenys dažniausiai neįgyja įrodomosios galios. Todėl šiame darbe išsikeltas tikslas atskleisti duomenų gautų iš atvirųjų informacijos šaltinių panaudojimo problematiką teisminiame bylų nagrinėjime. Šio tyrimo objektas – duomenų gautų iš atvirųjų informacijos šaltinių panaudojimas teisminiuose procesuose. Darbą sudaro trys skyriai, suskirstyti į poskyrius. Pirmojoje darbo dalyje apibūdinama duomenų bei atvirųjų informacijos šaltinių samprata, atskleidžiamas atvirųjų informacijos šaltinių teikiamos informacijos turinys bei pristatomi pagrindiniai asmens duomenų tvarkymą reglamentuojantys teisės aktai. Antrojoje darbo dalyje analizuojama įrodymų samprata Lietuvos teisinėje sistemoje, aptariami pagrindiniai įrodinėjimo vertinimo kriterijai pabrėžiant autentiškumo bei vientisumo svarbą, taip pat pristatomas nevyriausybinių organizacijų indėlis atvirųjų informacijos šaltinių analizės srityje. Trečiojoje darbo dalyje analizuojama tarptautinių ir Lietuvos teismų praktika bylose, kurias tiriant yra pasitelkiami duomenys gauti iš atvirųjų informacijos šaltinių. Darbo pabaigoje pateikiamos išvados ir pasiūlymai. Siekiant atskleisti pasirinktą temą, buvo iškelti keturi uždaviniai. Pirmuoju uždaviniu siekta išanalizuoti duomenų sąvokos sampratą ir pristatyti asmens duomenų teisinius tvarkymo ypatumus. Nagrinėta mokslinė ir teisinė literatūra, atskleista duomenų kvalifikacijų įvairovė bei pristatyti svarbiausi asmens duomenų apsaugą reglamentuojantys teisės aktai. Antruoju uždaviniu siekta apibūdinti atvirųjų informacijos šaltinių sampratą ir atskleisti jų teikiamos informacijos turinį. Analizuota literatūra atskleidė atviruosiuose informacijos šaltiniuose esančių duomenų panaudojimo svarbą tiriant įvairaus pobūdžio teisės pažeidimus. Trečiuoju uždaviniu siekta apibūdinti įrodymų sampratą teisinėje sistemoje ir apžvelgti įrodinėjimo proceso ypatumus teisminiame bylų nagrinėjime. Analizuojant Lietuvos Respublikoje įrodymų sampratą ir įrodinėjimą reglamentuojančius teisės aktus, atskleisti įrodymams, o taip pat ir duomenims gautiems iš atvirųjų informacijos šaltinių, keliami reikalavimai. Ketvirtuoju uždaviniu siekta atskleisti duomenų gautų iš atvirųjų informacijos šaltinių panaudojimo problematiką Lietuvos ir tarptautinių teismų praktikoje. Analizuota teismų praktika, kuria remiantis atskleisti dažniausiai pasitaikantys iš atvirųjų informacijos šaltinių gautų duomenų trūkumai. Naudoti tyrimo metodai: teisės aktų, mokslinės literatūros ir kitų šaltinių turinio analizė, lyginamoji analizė, teismų praktikos analizė ir apibendrinimo metodas.
The topic of this master’s thesis is "Challenges in the use of data obtained from open-source information". In today’s society, with the rapid growth of publicly available information on the internet, particularly on platforms such as blogs and social media sites, open-source information are becoming an attractive tool for law enforcement agencies to collect important data, both in investigating criminal acts and in documenting the acts themselves and their traces specifically on the internet. However, although data obtained from open-source information can help reveal important factual circumstances in a case, such data generally lacks probative value in the evidentiary process during judicial proceedings. Therefore, the aim of the thesis is to examine the challenges in the use of data obtained from open-sources in judicial proceedings. The subject of this research is the use of data obtained from open-source information in judicial proceedings. The thesis is divided into three chapters, each with its own subsections. The first part of the thesis defines the concepts of data and open-source information, reveals the content of information provided by open-source information, and presents the main legal acts regulating the processing of personal data. The second part of the thesis analyzes the concept of evidence in the Lithuanian legal system, discusses the main criteria for evaluating evidence while emphasizing the importance of authenticity and integrity, and presents the contribution of non-governmental organizations to the field of open-source information analysis. The third part of the thesis analyzes the case law of international and Lithuanian courts in cases where data obtained from open-sources information is used. The thesis concludes with findings and recommendations. Four objectives were set to explore the chosen topic. The first objective is to analyze the concept of data and present the legal aspects of personal data processing. Academic and legal literature was reviewed, the diversity of data classifications was revealed, and the most important legal acts regulating the protection of personal data were presented. The second objective is to describe the concept of open-source information and reveal the content of the information they provide. The literature review revealed the importance of using data from open-source information when investigating various types of legal violations. The third objective is to describe the concept of evidence in the legal system and to review the specific features of the evidentiary process in judicial proceedings. By analyzing the legal acts regulating the concept of evidence and the burden of proof in the Republic of Lithuania, the requirements imposed on evidence, as well as on data obtained from open-sources information, were identified. The fourth objective is to reveal the challenges surrounding the use of data obtained from open-sources in the case law of Lithuanian and international courts. Court practice was analyzed to identify the most common shortcomings of data obtained from open sources. The research methods used in the study include the analysis of legislation, academic literature, comparative analysis, and court practice analysis.
