Baudžiamosiose bylose renkami su proceso dalyviais susiję ir turintys reikšmės tyrimui asmeninio pobūdžio duomenys, kurie teisėsaugos subjektams atskleidžiami dideliu mastu. Jurisprudencijai ir moksliniam ištyrimui stokojant platesnio asmens duomenų apsaugos principų taikymo bei esant viešojo intereso bei teisės į privatumą kolizijai, gali kilti visuomenės susirūpinimas dėl teisingo asmens duomenų apsaugos principų nuostatų perkėlimo į teisėsaugos praktiką. Siekiant išsiaiškinti ar Lietuvos baudžiamajame procese tinkamai įgyvendinami asmens duomenų apsaugos principų reikalavimai, svarbu išsiaiškinti ar asmens duomenų apsaugos mechanizmas nagrinėjant baudžiamąsias bylas yra pakankamai užtikrinantis asmens teisę į privatų gyvenimą, įvertinti ar teisėsaugos institucijose taikoma vienoda asmens duomenų apsaugos taisyklių praktika, taip pat, identifikuoti teisėtumo, sąžiningumo ir duomenų tvarkymo tikslo apribojimo principų taikymo problematiką baudžiamajame procese, ištirti ar baudžiamosiose bylose nerenkami pertekliniai ir netikslūs asmens duomenys, be to, nustatyti ar asmens duomenų saugojimo trukmės apribojimo ir duomenų saugumo principų taisyklės tinkamai perkeltos iš Europos Sąjungos teisinių šaltinių į nacionalinę teisę. Baigiamąjį darbą sudaro du skyriai – pirmajame analizuojant teisės aktus, mokslinius šaltinius ir jurisprudenciją, nagrinėjama asmens duomenų samprata, asmens duomenų apsaugos raidos ir teisinio instituto ypatumai bei ryšys su teise į privatumą. Antrajame skyriuje, pasitelkiant kokybinio interviu tyrimo su teisėsaugos subjektais rezultatus ir teismų praktiką, analizuojamas asmens duomenų apsaugos principų baudžiamajame procese taikymas bei problematika visose proceso stadijose. Baigiamajame darbe buvo išsiaiškinta, jog Lietuvos įstatyminė bazė asmens duomenų apsaugos baudžiamojo proceso kontekste – tinkamai perkelta iš Europos Sąjungos teisės aktų ir taikomas informacinio privatumo apsaugos mechanizmas yra pakankamas, tačiau praktikoje pasitaiko probleminių aspektų, kurie neturi didelės lemiamos reikšmės proceso baigčiai, veikiau rodo poreikį tobulinti esamą tvarką dėl nevienodos asmens duomenų apsaugos principų taisyklių taikymo praktikos.
In criminal cases, personal data related to the participants in the process and relevant to the investigation are collected, which are disclosed to law enforcement entities on a large scale. In the absence of a broader application of the principles of personal data protection in jurisprudence and scientific research, and in the presence of a conflict between the public interest and the right to privacy, public concern may arise regarding the correct transposition of the provisions of the principles of personal data protection into law enforcement practice. In order to clarify whether the requirements of the principles of personal data protection are properly implemented in the Lithuanian criminal process, it is important to clarify whether the personal data protection mechanism in the examination of criminal cases is sufficient to ensure the right of the individual to private life, to assess whether uniform practice of personal data protection rules is applied in law enforcement institutions, as well as to identify the problems of applying the principles of legality, fairness and purpose limitation of data processing in criminal proceedings, to investigate whether excessive and inaccurate personal data are collected in criminal cases, and to determine whether the rules on the limitation of the duration of personal data storage and the principles of data security have been properly transposed from the legal sources of the European Union into national law. The thesis consists of two chapters - the first, analyzing legal acts, scientific sources and jurisprudence, examines the concept of personal data, the development of personal data protection and the peculiarities of the legal institute and the connection with the right to privacy. The second chapter, using the results of a qualitative interview study with law enforcement entities and case law, analyzes the application of personal data protection principles in criminal proceedings and the problems at all stages of the process. The thesis found that the Lithuanian legislative framework for the protection of personal data in the context of criminal proceedings - properly transposed from European Union legal acts and the applied information privacy protection mechanism is sufficient, but in practice there are problematic aspects that do not have a significant decisive significance for the outcome of the process, rather they indicate the need to improve the current procedure due to the uneven practice of applying the rules of personal data protection principles.
