Šiuo magistro baigiamuoju darbu, kurio tyrimas orientuotas į Komisijos ataskaitas ir siūlomus ,,Bendrųjų teisės principų“ tema 2 – 7 išvadų projektus bei šių siūlymų santykį su valstybių (dominuojančiu) požiūriu, siekiama atskleisti šiuolaikinę bendrųjų teisės principų sampratą TTT statuto 38 str. kontekste. Įgyvendinant šį tikslą lygiagrečiai identifikuojama šio Komisijos darbo reikšmė, išgryninami Komisijos išskirtų bendrųjų teisės principų kategorijų požymiai, identifikuojama pripažinimo subjektų problematika, terminologijos nuoseklumo problematika, valstybių dominuojantis požiūris ir jo santykis su specifiniais minėtų Komisijos siūlomų išvadų projektų aspektais.
This master‘s thesis, whose research focuses on the Commission‘s reports and proposed 2 – 7 draft conclusions on ‘‘General Principles of Law“, and the relationship between these proposals and the (dominant) perspective of the States, aims to reveal the contemporary of general principles of law in the context of Article 38 of the statute of the ICJ. In pursuing this objective, the significance of this Commission‘s work is simultaneously identified, the characteristics of the categories of general principles of law distinguished by the Commission are clarified, the issue of the subjects of recognition is identified, issues of terminological consistency, the prevailing view of the States, and its relationship to specific aspects of the draft conclusions proposed by the Commission.
