Šiame magistro baigiamajame darbe atskleidžiama laisvės atėmimo iki gyvos galvos bausmės vieta bausmių sistemoje ir jos teisinio reguliavimo raida Lietuvoje. Taip pat nagrinėjamos laisvės atėmimo iki gyvos galvos pakeitimo terminuota laisvės atėmimo bausme sąlygos bei peržiūros ir pakeitimo terminuota laisvės atėmimo bausme modeliai. Nagrinėjamas Lietuvos valstybės pasirinktas bausmės peržiūros mišrus modelis. Nustatyta, kad laisvės atėmimo iki gyvos galvos bausmės instituto formavimuisi esminę reikšmę turėjo mirties bausmės panaikinimas Lietuvoje. Nustatyta, kad pakeitimas terminuota laisvės atėmimo bausme yra griežtas procesas. Teismais vertina nuteistojo nusikalstamo elgesio riziką, elgesį bausmės atlikimo metu, bausmės tikslų pasiekimą ir žalos atlyginimo klausimus. Šios sąlygos yra vertinamojo pobūdžio ir vertinamos kiekvienu atveju individualiai, tad sprendimas dėl bausmės sušvelninimo paliekamas teismo diskrecijai. Taip pat analizė atskleidė Lietuvos valstybės pasirinkto mišraus modelio problematiką, kuri siejama su būdingu griežtumu, ko pasėkoje reali galimybė pasinaudoti bausmės sušvelninimu ar lygtiniu paleidimu dažnai tampa sudėtinga. Ilgas bausmės švelninimo procesas gali mažinti nuteistųjų motyvaciją keistis, didinti valstybės finansinę naštą dėl ilgalaikio asmenų laikymo įkalinimo įstaigose.
This master’s thesis examines the place of life imprisonment within the penal system and the evolution of its legal regulation in Lithuania. It also examines the conditions for commuting life imprisonment to a fixed-term prison sentence, as well as models for reviewing and commuting life imprisonment to a fixed-term prison sentence. The mixed model of sentence review chosen by the Lithuanian state is analyzed. It has been established that the abolition of the death penalty in Lithuania played a crucial role in the development of the institution of life imprisonment. It has been established that the conversion to a fixed-term prison sentence is a rigorous process. The courts assess the risk of the convicted person’s criminal behavior, their conduct during the sentence, the achievement of the sentence’s objectives, and issues of compensation for damages. These conditions are of a discretionary nature and are assessed on a case-by-case basis, so the decision to commute a sentence is left to the court’s discretion. The analysis also revealed the challenges of the hybrid model chosen by the Lithuanian state, which is associated with inherent strictness, making it often difficult to realistically take advantage of sentence mitigation or parole. The lengthy process of sentence mitigation may reduce the motivation of convicts to change and increase the financial burden on the state due to the long-term detention of individuals in correctional facilities.
