Šio magistro darbo nagrinėjama tema – savarankiškai dirbančių asmenų teisinis reglamentavimas Lietuvoje. Darbo tikslas: išanalizuoti savarankiškai dirbančių asmenų teisinio reglamentavimo turinį, nustatyti pagrindinius probleminius aspektus bei įvertinti jų taikymą praktikoje. Šiuolaikinėje darbo rinkoje savarankiška veikla tampa vis aktualesnė, nes sudaro galimybes asmenims savarankiškai organizuoti savo profesinę veiklą, tačiau kartu kelia teisinio reglamentavimo aiškumo ir nuoseklumo problemų. Darbo objektas: savarankiškai dirbančių asmenų teisinis reglamentavimas Lietuvoje. Darbe keliami probleminiai klausimai, susiję su teisinio reguliavimo nuoseklumu, savarankiškai dirbančio asmens sampratos aiškumu, socialinių garantijų užtikrinimu bei teismų praktikos reikšme aiškinant šių asmenų teisinį statusą. Darbe iškelti keturi pagrindiniai uždaviniai. Pirmiausia siekta atskleisti savarankiškai dirbančių asmenų sampratą, jų požymius bei veiklos formas Lietuvoje ir Europos Sąjungoje. Antruoju uždaviniu analizuotas savarankiškos veiklos teisinis reglamentavimas Lietuvoje, įvertinant skirtingų veiklos formų teisinio reguliavimo ypatumus. Trečiuoju uždaviniu nagrinėti savarankiškos veiklos vykdymo ypatumai, įskaitant nepilnamečių dalyvavimą veikloje, veiklą nesteigiant juridinio asmens bei apmokestinimo aspektus. Ketvirtuoju uždaviniu analizuoti statistiniai duomenys ir teismų praktika, siekiant nustatyti savarankiškos veiklos reglamentavimo taikymo problemas. Tyrimas parodė, kad savarankiškos veiklos teisinis reglamentavimas Lietuvoje yra fragmentiškas, nes grindžiamas skirtingų teisės aktų visuma, o tai lemia nevienodą teisių, pareigų, apmokestinimo ir socialinio draudimo sąlygų taikymą. Nustatyta, kad skirtingos veiklos formos pasižymi skirtingais apmokestinimo modeliais, kurie daro tiesioginę įtaką veiklos organizavimui ir ekonominiams rezultatams. Analizė taip pat atskleidė, kad savarankiška veikla Lietuvoje yra plačiai paplitusi, tačiau praktikoje kyla ginčų dėl jos kvalifikavimo. Teismų praktika rodo, kad sprendžiant šiuos ginčus lemiamą reikšmę turi faktinės veiklos aplinkybės, o ne formalus jos įforminimas. Magistro darbe taikyti šie tyrimo metodai: mokslinės literatūros analizė, teisės aktų analizė, lyginamasis, sisteminis, teismų praktikos ir statistinių duomenų analizės metodai.
The topic of this master‟s thesis is the legal regulation of self-employed persons in Lithuania. The aim of the thesis is to analyses the content of the legal regulation of self- employed persons, to identify the main problematic aspects, and to assess their application in practice. In the modern labor market, self-employment is becoming increasingly relevant, as it provides individuals with opportunities to independently organize their professional activities; however, it also raises issues related to the clarity and consistency of legal regulation. The object of the research is the legal regulation of self-employed persons in Lithuania. The thesis raises problematic questions related to the consistency of legal regulation, the clarity of the concept of a self-employed person, the provision of social guarantees, and the significance of case law in interpreting the legal status of such persons. The thesis sets four main objectives. First, to reveal the concept, characteristics, and forms of self-employment in Lithuania and the European Union. Second, to analyses the legal regulation of self-employment in Lithuania by evaluating the peculiarities of different forms of activity. Third, examine the specific features of self-employment, including the participation of minors, activities without establishing a legal entity, and taxation aspects. Fourth, to analyses statistical data and case law in order to identify problems in the application of the legal regulation of self-employment. The research has shown that the legal regulation of self-employment in Lithuania is fragmented, as it is based on a set of different legal acts, which leads to differences in the application of rights, obligations, taxation, and social security conditions. It has been established that different forms of self-employment are characterized by different taxation models, which have a direct impact on the organization of activities and economic outcomes. The analysis also revealed that self-employment is widespread in Lithuania; however, in practice, disputes arise regarding its qualification. Case law shows that, when resolving such disputes, decisive importance is given to the actual circumstances of the activity rather than its formal expression. The following research methods were applied in the thesis: analysis of scientific literature, analysis of legal acts, comparative method, systematic method, as well as analysis of case law and statistical data.
