Europos žmogaus teisių konvencijos (EŽTK) 8 straipsnis ir Europos Sąjungos pagrindinių teisių chartijos (Chartija) 8 straipsnis suteikia Europos Tarybos (ET) ir Europos Sąjungos (ES) valstybių narių piliečiams teisę į asmens duomenų apsaugą, reiškiančią, kad jų asmens duomenys turi būti tinkamai tvarkomi, naudojami konkrečiai apibrėžtiems tikslams esant atitinkamo asmens sutikimui arba kitiems įstatymo nustatytiems teisėtiems pagrindams. 2013 m. E. Snowdenui paviešinus Jungtinių Amerikų Valstijų (JAV) ir sąjungininkės Didžiosios Britanijos vykdomo asmens duomenų rinkimo mastus pagal PRISM programą paaiškėjo, jog praktiškai visa ET ir ES valstybių narių piliečių bei kitų asmenų komunikacija elektroninėje erdvėje, apimanti tiek šios komunikacijos meta duomenis, tiek ir jos turinį, yra renkama ir tvarkoma JAV žvalgybos institucijų. Priešingai nei Europoje, asmens duomenų apsaugos klausimai JAV paprastai yra paliekami savireguliacijai, tačiau tai nėra taikoma ypatingai jautrioms sritims, kurioms priskiriama ir teisėsaugos bei žvalgybos veikla elektroninėje erdvėje. JAV vykdomo asmens duomenų rinkimo elektroninėje erdvėje metodai ir apimtys yra reglamentuojami keliais JAV teisės aktais: Elektroninės komunikacijos privatumo aktu (angį. Electronic Communication Privacy Act (ECPA)), Užsienio žvalgybos elektroninėje erdvėje aktu (angį. Foreign Intelligence Surveillance Act (FISA)), Vykdomuoju nurodymu 12,333 (angį. Executive Order 12,333) bei iš dalies Federalinio baudžiamojo proceso kodekso 41 taisykle (angį. Rule 41). Kadangi teisė į asmens duomenų apsaugą nėra absoliuti, todėl gali būti teigiama, jog tai, kad JAV žvalgybos ir teisėsaugos institucijos asmens duomenų rinkimą vykdo pagal teisės aktuose numatytus reikalavimus, reiškia, kad ir teisės į asmens duomenų apsaugą suvaržymas yra teisėtas. Šiame straipsnyje yra analizuojami JAV žvalgybos institucijų naudojami asmens duomenų rinkimo elektroninėje erdvėje metodai bei šią veiklą reglamentuojantys JAV teisės aktai. Analizės metu atskleidžiama, kad JAV žvalgybos institucijų taikomi kriminalistiniai asmens duomenų rinkimo elektroninėje erdvėje metodai neatitinka nei ET, nei ES reikalavimų dėl teisėtų teisės į asmens duomenų apsaugą suvaržymo sąlygų. Vadinasi, didžioji dauguma ET ir ES piliečių asmens duomenų elektroninėje erdvėje nėra apsaugoti nuo JAV vykdomo masinio asmens duomenų rinkimo, nors toks tikslas buvo keliamas pasirašant JAV ir ES Privatumo skydo susitarimą (angį. Privacy Shield agreement).

Declaration of necessity to improve the level of data protection in all spheres of European Union (EU) policy under the Stockholm program was the impetus for European Commission to start the data protection reform in EU, particularly paying more attention for data protection regulation in the investigation and prosecution of crime. On the other hand, Council conclusions on the vision for European Forensic Science 2020 including the creation of a European Forensic Science Area and the development of forensic science infrastructure in Europe introduces reform on forensic science. One of the objectives thereof is creation of conditions for the free movement of data relevant to law enforcement institutions in EU. While having no direct connection in EU policy making documents the aforementioned reforms are closely connected: free movement of such a data is impossible if the unified data protection regulation would not be applied in forensic science institutions. Therefore, the role of data protection regulation for a proper implementation of vision for European Forensic Science 2020 and the interconnection of both reforms are being discussed in this publication.

and knowledge in investigation of crimes emphasised in EU Council conclusions on the vision for European Forensic Science 2020 including the creation of a European Forensic Science Area and the development of forensic science infrastructure in Europe: trafficking in human beings, organised crime and terrorism; 3) analysing the conceptions of criminalistics which differ through Europe due to variety of criminalistics schools and finding areas for its harmonization. As a result of the Project, not only conception of implementation of vision for European Forensic Science 2020 in Lithuania will be created but also its main provisions will be relevant to other EU countries. Consequently, the presented conception of implementation of vision for European Forensic Science 2020 in Lithuania could be an initiative for the common European Forensic Science vision and contribute to the creation of EU as an area of freedom, security and justice. The objectives of this article on one the hand are to present the main ideas of conception of the vision for European Forensic Science 2020 of EU Council and on the other hand – shortly introduce the Project, implementation which has just started in Lithuania, and its main tasks.

the presented conception of implementation of vision for European Forensic Science 2020 in Lithuania could initiate a project for a common vision of European Forensic Science and contribute to the development of the EU as an area of freedom, security and justice. The article presents main ideas of the project of the conception of the vision for European Forensic Science 2020 of EU Council and analyses its legal background, as well as prospects of and challenges for its implementation in Lithuania and the EU.

The value of forensic science for the investigation of crimes and assurance of freedom, security and justice has been assessed recently. Therefore, the first researches on forensic science appeared not only in the United States of America but also in European Union. The objective of the European Commission to create the common European Forensic Science Area marks the beginning of harmonization of forensic science, its expansion from national into international level and also requires the improvement of forensic science in many member states. The Ministry of Justice of the Republic of Lithuania agrees that the current system of forensic science in Lithuania is organized and works improperly. Therefore, the first steps for the reform on forensic science in the connection with creation of common European Forensic Science Area has just taken in Lithuania
