The paper seeks to identify the role of Tobias Barreto at the development of an original Brazili-an legal philosophy, at themid XIX century. Barreto, as shown by the studies on the back-ground of the present article, can be pointed out as one of the greatest responsible for the philo-sophical awakening of a peripheral society, which was still very connected to the ancients ideasof the imperial and colonial times.
O artigo procura identificar o papel de Tobias Barreto no desenvolvimento de uma filosofia jurídica originalmente brasileira, em meados do século XIX. Barreto, como mostram os estudos que serviram de base para o presente estudo, pode ser apontado como um dos maiores responsáveis pelo despertar filosófico de uma sociedade periférica, ainda muito ligada às ideias dos antigos tempos imperial e colonial.
