Legal basis of social dialogue

The article deals with the aspects of regulation of social dialogue according to International Law, European Union (later in the text - EU) Law, and the Law of the Republic of Lithuania; the definition of social dialogue and its legal bas is (subjects, object), forms of implementation both in the EU and Lithuania are at issue. The definition of social dialogue is influenced by specific type of social labour relations. It is determined by market economy and globalization processes, considering that globalization involves direct foreign investments, which effects the increasing role of international companies and their relative significance, as well as internationalization of financial markets, decrease of national regulation and liberalization, privatization of national sector. Thus the effective management of labour sphere, the protection of human rights and the assurance of necessary labour conditions standards become more urgent. The establishment of global management and regulation rules (norms) has become major EU institutions and its member states activity, the results of which not only have considerable influence on Lithuanian government, employers' and employees' organizations, adopting labour policy related decisions, implementation of investigation activities and European labour standards to daily work, local control of implementation, but also each individual worker who is realizing his/her right to labour conditions in compliance with international standards.
