Abstract

In the article „The Prospects of the Death Penalty Abolition" a fairly actual problem of the death penalty abolition is being explored. The author reveals the essence of this sanction and the goals of its imposition. The emphasis is also emphasized on the inadequacy of national laws regulating the imposition of the death penalty to the norms of the Universal Declaration of Human Rights and to the other instruments of international law. In the article the reader can find the attempt to answer the question of what impedes the abolition of the death penalty. In the opinion of the author, the abolition of the death penalty hinges not only upon the influence of international institutions but also upon the state of culture of a given society, its political, economical situation and criminogenical state, its self-consciousness, and its view on this kind of criminal penalty.
