This article deals with one of the most recent and in practice really topical issues – the concept and legal regulation of abuse of rights in criminal proceedings. It analyses legislative initiatives and illustrates real examples from Lithuanian jurisprudence, while at the same time discussing the experience of Polish scholars in this area. In particular, the systematic, comparative and documentary analysis allows answering the questions of the requirements for the regulation of the prohibition of abuse of rights in criminal proceedings in the laws on criminal procedure. At the same time, it should be noted that this analysis allows for an understanding of the content of the prohibition under analysis and the consequences of non-compliance with this prohibition.
