Straipsnyje analizuojamos vietinio (lokalaus) teisinio darbo santykių reguliavimo prielaidos. Taip pat atskleidžiama vietinių (lokalių) teisės aktų teisinė prigimtis ir šiuo metu Lietuvoje galiojanti vietinių (lokalių) teisės aktų sistema, iškeliamos šioje srityje egzistuojančios problemos ir pateikiami pasiūlymai, kaip jas spręsti.
In the article, the presumptions of the local (localised) legal regulation of labour relations are analyzed; the legal nature of local (localised) legal acts and the system of the local (localised) legal acts which is now effective in Lithuania are also revealed. It is noted that while implementing the duty to approve the local (localised) legal acts in Lithuania in practice, there arises a problem of “small employers” (employers who only have up to 50 employees working for them), which is proposed to be solved by amending the Article 230 of the Labour Code, by enshrining therein, that in the enterprise in which there are no representatives of the employees (functioning trade unions, non-elected labour council or representative of the employees), the work procedure is not established by the rules of work procedure, but by laws, orders, etc., which would be adopted only by the employer and which would not be necessarily coordinated with representatives of the employees. The legal nature of the local (localised) legal acts is also analyzed. Having analyzed the theories (the theories of the Legal Norms, Contract and Existing Custom) of the legal nature of the local (localized) norms which exist in the theory of law, and having assessed the overall legal regulation, the conclusion is drawn that in Lithuania, the legal nature of the local (localized) norms mostly conforms with the statements of the theory of the Legal Norms, and the local (localized) legal acts are the collections of rules of conduct of the normative nature which are functioning in the enterprise and whereby the work procedure is established, and that they express the normative method of legal regulation.
