Abstract
Undoubtedly, the one of the potential benefits of the European Small Claims Procedure is that it implements the unified contentious proceedings and eliminates exequatur. In the real life, however, this European cross-border instrument still remains more an objective than a realistic instrument, enabling businesses to feel confident about simple enforcement of their rights in any Member State.
