Straipsnyje nagrinėjamas žmogaus orumas kaip teisinė vertybė. Visų pirma straipsnyje aptariama žmogaus orumo samprata ir jos pavyzdžiai iš skirtingų istorinių laikotarpių. Antra, analizuojama, kaip teisės į orumą apsauga ir gynimas įgyvendinimas valstybės viduje ir tarptautinėse teisminėse institucijose. Nagrinėjama, kaip teisė į orumą įtvirtinta Lietuvos Respublikos Konstitucijoje. Konstitucijoje kaip aukščiausią teisinę galią turinčiame teisės akte įtvirtinta nuostata, kad žmogaus orumas yra prigimtinė, neliečiama ir neatimama vertybė, kurią valstybė saugo ir gina. Tai suponuoja, kad orumas yra absoliuti teisė, visų žmogaus teisių pagrindas, suvokiamas kaip fundamentas, kuris formuoja visą teisinę sistemą. Straipsnyje, be kita ko, aptariama orumo kaip teisinės vertybės sampratos turinio transformacija, iškylanti dėl besikeičiančio teisės į žmogaus orumą turinio aiškinimo teismų praktikoje. Teisės į orumą sampratos transformacija rodo dinamišką teisės raidą, atspindinčią besikeičiančias visuomenės vertybes ir XXI amžiaus socialinius iššūkius.
This article deals with the concept of human dignity as a legal value; as an object of human law, understood as a core concept of moral consciousness which universally belongs to everyone, simply by virtue of being human. In particular, the article discusses the concepts of human dignity in different historical periods and provides an understanding of values. Secondly, it analyses how the protection and defence of the right to dignity is manifested in the exercise of the right to dignity within the state and in international judicial institutions. It analyses how dignity is enshrined in the Constitution of the Republic of Lithuania. The Constitution, which is the supreme legal act, establishes that human dignity is an inherent, inviolable and inalienable value which the State protects and defends. This implies that dignity is an absolute right; the basis of all human rights, understood as the foundation that shapes the entire legal system. Finally, the transformation of the content of the concept of dignity as a legal value is discussed in the context of increasingly broad and dynamic interpretation by the courts. Legal practice is changing, and the transformation of the concept of the right to dignity reflects the dynamic evolution of the law, reflecting the changing values of society and the social challenges of the 21st century.
