    This section of the book is devoted to the presentation of a basic temporal (diachronic) and systematic (synchronic) overview of the legal system of Lithuania. Two dimensions are covered from the diachronic perspective. The first one is a retrospective or historical overview of the historical development of Lithuanian law from the medieval period, covering the monumental Statutes of the Grand Duchy of Lithuania, to the major law-related events of contemporary Lithuania. The second diachronic perspective is a prospective overview in which the perspectives of the future development of Lithuanian law in the major legal fields (such as constitutional, labor, civil, procedural, and so forth) are presented and analyzed. The synchronic overview of Lithuanian law also proceeds in two dimensions. The first one is devoted to the presentation of the system of law “from inside” by surveying the basic aspects of the system of Lithuanian courts and some other institutions/officials (prosecutors, attorneys, notaries, and bailiffs) that play important roles in the implementation of justice. The second one focuses more on the influences to the system “from outside,” although with a hybrid angle. First, the Lithuanian legal system is positioned in the larger domains of international law and the law of the European Union. Subsequently, specific attention is paid to the insurance of state security through/by the system of law, where not only the dangers of an internal (focus to the system of internal affairs and police) but also those of an external (focus to the system of national defense) nature are covered.

    Europos Sąjunga yra labai priklausoma nuo energijos šaltinių importo, o didelės energijos kainos neigiamai veikia jos konkurencingumą. Todėl 2009 m. ir 2010 m. Europos Sąjungos institucijos priėmė daug sprendimų bei teisės aktų susijusių su energetikos sektoriumi. Vienas iš pagrindinių tikslų - užtikrinti nepertraukiamą, pagrįstų kainų energijos tiekimą visiems vartotojams bei didinti energijos tiekimo efektyvumą. Straipsnyje siekiama išanalizuoti ar valstybės narės tinkamai perkelia Europos Sąjungos Energetikos direktyvų nuostatas ir pabandyti nustatyti tam tikrus dėsningumus. Analizuojama dėl kokių Energetikos direktyvų ir prieš kokias valstybes nares Komisija yra pradėjusi procedūras ar pateikusi ieškinius į Europos Sąjungos Teisingumo Teismą dėl įsipareigojimų nevykdymo.

    Nors Lietuva priėmė teisės aktus, sudarančius prielaidas konkurencijai elektros ir dujų rinkose bei šilumos ūkio sektoriuje atsirasti, tačiau praktinių rezultatų energijos rinkose dar tenka laukti. Todėl pagrįstai gali būti abejojama, ar teisinio reguliavimo liberalizavimo pakanka konkurencijai energijos rinkose skatinti, jei ne, tai kokios priemonės ir metodai bei kokie subjektai galėtų paskatinti greitesnį konkurencijos atsiradimą. Šiame straipsnyje apsiribojama tik Valstybinės kainų ir energetikos kontrolės komisijos, kaip subjekto, galinčio daryti įtaką konkurencijos atsiradimui energijos rinkose, aptarimu. Straipsnyje analizuojama, kaip turi keistis ekonominio reguliavimo institucija, kad rinkos liberalėtų, ir daroma išvada, kad energetikos sektoriaus reguliavimo sistema bus neefektyvi, jei ekonominiam reguliatoriui nebus suteiktos papildomos galios, būtinos tinkamai energijos rinkų dalyvių (ypač privataus ar užsienio kapitalo) priežiūrai.

    The aim of this article is to address the regulatory framework as one of the key factors determining the success of creation of single market for renewable energy. No one could possibly argue that non-discriminative and consistent legal regulation plays a big role in the creation of a single market. Therefore, the question of legal capability to create the single market for renewable energy and the overall quality of present regulatory framework is at the centre of this article. Our objective is to analyse whether the single market for energy produced from renewable sources can be created under current legal regulation of the European Union Therefore, the first part of the article analyses the competence of the European Union to regulate the renewable energy sector and division of legislative powers between the Member States and the European Union. The goal of the first part is to answer the question whether the European Union has the competence to regulate renewable energy market. The second part of the article analyses the legal framework of measures for the promotion of renewable energy production used in each Member State. The goal of the second part of this article is to answer the question – whether all renewable energy producers are in equal competitive position, notwithstanding different legal frameworks of the Member States.

    Atsinaujinančių energijos išteklių (AEI) plėtra didina šalies viduje išgaunamos energijos kiekį bei energijos šaltinių įvairovę ir tokiu būdu mažina importuojamos energijos poreikį bei priklausomybę nuo energijos išteklius eksportuojančių valstybių. 2010 m. atsinaujinančios energijos išteklių dalis bendrose energijos sąnaudose Lietuvoje sudarė 15,2 proc. – pažanga akivaizdi, tačiau keliais procentiniais punktais vis tik atsiliekama nuo numatyto grafiko. Kita vertus, ES finansinė bei politinė parama, kaip ir Atsinaujinančių išteklių energetikos įstatyme numatytos AEI vartojimo skatinimo priemonės turėtų užtikrinti norimą pažangą.

    The research showed that the restructuring and changes in ownership of energy companies still have not enhanced the competition in Lithuanian electricity market. Electricity policy goals - to ensure the strategic reliability of electricity supply and integrate Lithuania into the European Union market - have not been accomplished yet. The major supplier of electricity remains Russia and the electricity power system is still not connected to Western Europe and Nordic countries. However, the companies carrying out the interconnection projects, managing Electricity power exchange and coordinating the construction of a new nuclear power plant are established. These changes give rise to thinking, that Lithuania is on the way to liberalization of electricity market.

    The main conclusion is that that the creation of LEO LT AB is inconsistent with the ownership unbundling model, which is the most favored by European Commission, as future legislative policy of the European electricity market and the best for enhancement of competition in the sector.
