Atsižvelgiant į tai, kad valstybės sienos apsauga yra viena iš prioritetinių vykdomosios valdžios veiklos krypčių jai skiriamas atitinkamas dėmesys. Taip pat dėl sienos apsaugos politikos svarbos ir pobūdžio valstybės sienos apsaugą reglamentuoja ne tik nacionaliniai teisės aktai bet ir tarptautinės sutartys bei kiti tarptautiniai teisės aktai. Dėl teisės aktų gausos jų įvairovės bei nuolatinio keitimosi (nestabilumo) sudėtinga vienokį ar kitokį teisinį santykį reglamentuoti tinkamai, kad jis atitiktų visus teisės aktams keliamus reikalavimus. Tad giliau panagrinėję vienokią ar kitokią sferą reglamentuojančius teisės aktus, juose galime aptikti vienokių ar kitokių netikslumų, neatitikimų ar prieštaravimų kitiems teisės aktams. Šiame straipsnyje bus bandoma panagrinėti kai kuriuos teisės aktus reglamentuojančius valstybės sienos ir Valstybės sienos apsaugos tarnybos (toliau VSAT) veiklą bei atskleisti juose aptiktus prieštaravimus, neatitikimus kitiems teisės aktams (kolizijas). Darbo tikslas - vadovaujantis lyginamuoju ir analizės metodu nustatyti (aptikti) valstybės sienos apsaugą reglamentuojančiuose teisės aktuose kolizijas, bei pabandyti pasiūlyti racionalių jų sprendimo metodų bei variantų. Rašant darbą remtasi literatūra, kurios sąrašą pagrinde sudaro teisės aktai tiek tarptautiniai, tiek nacionaliniai, reglamentuojantys valstybės sienos apsaugą bei VSAT veiklą.
Officers the position and competence whereof allows of implementing the functions of the Service, in the borderline strip, State border protection zone, frontier zone, border crossing points, secured facilities and territories, territorial sea and frontier inland waters, shall implement these functions following the procedure established by legal acts and for this purpose, they shall have the right to: verify the necessary documents of persons and means of transport, inspect means of transport, and in places where there is no Customs Office, examine freight documents; conduct person’s search and baggage check, detain persons suspected of having violated the rules of crossing the State border or regulations of the customs, frontier zone or border crossing point, bring the violators to the official facilities of the Service or police or to neighbourhoods in rural areas, in order to establish the identities and to write up a record of violation of administrative law; summon persons to the official facilities of the Service, police, or other law enforcement institution and obtain explanations thereof, concerning illegal crossing of the State border of which they are aware, circumstances of violations of the rules of the border crossing point operation, and if the summoned persons fail to present themselves without an important reason, to bring them in; pursue violators of the State border throughout the entire territory of the Republic of Lithuania and apprehend them and etc.
