Abstract (lt)

Šio straipsnio tikslas – išanalizuoti, kaip teismai, vienintelė institucija, vykdanti teisingumą, formuluodami praktiką, traktuoja teisingumo principą ir su kokiomis pagrindinėmis problemomis susiduria, jį įgyvendindami. Siekiant šio tikslo, tekste analizuojama teisingumo principo samprata teisės teorijoje ir filosofijoje, remiantis teismų praktika, Lietuvos bei užsienio teisės doktrina, nagrinėjamas šio teisės principo turinys, atskleidžiant teisingumo principo svarbą dabartiniu laikotarpiu. Be to, analizuojamas teismų vaidmuo įgyvendinant teisingumą, aptariamas teisingumo principo teisminis aiškinimas. Šiame darbe išskiriamos dabartiniu laikotarpiu svarbiausios teisingumo principo įgyvendinimo problemos. Taip pat atkleidžiama teisingumo, kaip teisės principo, sampratos vieta plačiame teisingumo sampratos diskurse.

Abstract (en)

The aim of this article is to analyze how courts—as the only institutions that administer justice—interpret the principle of justice when developing legal practice, and what the main challenges are in implementing this principle. To achieve this goal, the article examines the concept of the principle of justice in legal theory and philosophy. Based on court practice, as well as Lithuanian and foreign legal doctrine, the content of this legal principle is analyzed, and the significance of the principle of justice in the present period is revealed. In addition, the role of the courts in the administration of justice and the judicial interpretation of the principle of justice are also examined. The article identifies the most pressing issues related to the implementation of the principle of justice today and explores the place of the concept of justice as a legal principle within the broader discourse on justice.
