Teisės į minties laisvę sampratos permąstymas dabartinėje saugumo atmosferoje yra neišvengiamas. Tam gali pasitarnauti filosofo Imanuelio Kanto autonomijos principas, kurio pagrindu skyriuje diskutuojama teisės į minties laisvę ir jos sampratos tematika. Keliamas klausimas, ar tradicinis teisės skirstymas į forum internum ir forum externum nėra atgyvenęs ir teisės į minties laisvę atveju galimai neatitinkantis realybės. Lyginamosios analizės būdu apžvelgiama, kaip skiriasi konstitucinis teisinis reguliavimas Europos valstybėse. Taip pat analizuojama teisės į minties laisvę interpretacija, išdėstyta Lietuvos Respublikos Konstitucinio Teismo ir Europos Žmogaus Teisių Teismo praktikoje. Galiausiai atkreipiamas dėmesys į šios dienos iššūkius – dezinformaciją, propagandą ir neapykantos kurstymą – kaip netiesioginę intervenciją į teisės į minties laisvę esmę. Straipsnyje konstatuojama, kad autonomijos principu kaip metodologiniu pagrindu galima pasiremti permąstant teisės į minties laisvę turinio esmę. Sutinkant, kad minties laisvės samprata yra pakitusi, pažymima, kad reikalingas ir paplitusio skirstymo į forum internum ir forum externum pokytis. Minties laisvei apsaugoti pravartu toliau plėtoti išplėstinės minties sampratos teisėje įsitvirtinimo galimybių tyrimus. Konstitucinis teisinis reguliavimas Europoje yra panašus, dažniausiai lakoniškai apibrėžiantis teisės į minties laisvę nuostatą. Teismų praktika teisės į minties laisvę klausimu dažniausiai ją analizuoja netiesiogiai, t. y. per teisės į sąžinės, religijos, orumo ar privatumo aspektus. Šiuolaikinėje realybėje, kurioje teisė į minties laisvę laikoma demokratinės visuomenės pagrindu, kuomet smegenų skenavimo ir minčių skaitymo technologijos nuolat tobulinamos, kai dezinformacijos, propagandos mašina ir neapykantos kurstymo atvejų gausa skverbiasi į socialinio gyvenimo realybę, koreguodami asmens, asmenų grupės ar visuomenės mąstymą, mintis ir vertybines nuostatas, neišvengiamai tampa svarbu permąstyti teisės į minties laisvę sampratą. Nes permąstant teisę į minties laisvę, permąstomi ir demokratijos esmės ir jos atsparumo klausimai.
Rethinking the concept of the right to freedom of thought is inevitable in the current security atmosphere. The principle of autonomy of the philosopher Immanuel Kant can serve as a basis for this, on the basis of which the chapter discusses the topic of the right to freedom of thought and its concept. The question is raised whether the traditional division of law into forum internum and forum externum is not outdated and, in the case of the right to freedom of thought, may not correspond to reality. A comparative analysis is used to review how constitutional legal regulation differs in European countries. The interpretation of the right to freedom of thought, set out in the practice of the Constitutional Court of the Republic of Lithuania and the European Court of Human Rights, is also analyzed. Finally, attention is drawn to today's challenges - disinformation, propaganda and incitement to hatred - as an indirect intervention in the essence of the right to freedom of thought. The article states that the principle of autonomy can be used as a methodological basis when rethinking the essence of the content of the right to freedom of thought. While agreeing that the concept of freedom of thought has changed, it is noted that a change in the widespread division into forum internum and forum externum is also necessary. In order to protect freedom of thought, it is useful to further develop research into the possibilities of establishing an expanded concept of thought in law. Constitutional legal regulation in Europe is similar, usually defining the provision of the right to freedom of thought in a concise manner. Court practice on the issue of the right to freedom of thought usually analyzes it indirectly, i.e. through the aspects of the right to conscience, religion, dignity or privacy. In the modern reality, in which the right to freedom of thought is considered the basis of a democratic society, when brain scanning and mind-reading technologies are constantly being improved, when disinformation, propaganda machines and an abundance of cases of incitement to hatred penetrate the reality of social life, adjusting the thinking, thoughts and value attitudes of a person, a group of people or society, it inevitably becomes important to rethink the concept of the right to freedom of thought. Because rethinking the right to freedom of thought also rethinks the essence of democracy and its resilience.
