Straipsnyje nagrinėjamas konstitucinės teisės moksle nuolat iškylantis konstitucinės interpretacijos specifiškumo klausimas. Vienų autorių teigimu, konstitucijos ir įstatymų bei kitų ordinarinės teisės aktų aiškinimai skiriasi, t. y. jie įžvelgia konstitucijos aiškinimo specifiką ar ypatumus. Kiti autoriai linkę manyti, kad tarp tų aiškinimų didesnio skirtumo nėra arba skirtumai yra tik kiekybinio pobūdžio. Tarp pastarąjį požiūrį mūsų dienomis palaikančių konstitucionalistų šiai grupei tipiškus argumentus yra išdėstę R. Guastini, M. Luciani ir D. A. Celis Vela. Eisime tokiu tyrimo keliu: pirmiausia aptarsime konstitucijos aiškinimo specifikos neigėjų teiginius, paskui aiškinsimės, ar konstitucijos, šalies aukščiausiosios pirminės steigiamosios teisės, ypatingumas lemia vienokią ar kitokią jos aiškinimo specifiką. Šiuo aspektu mums svarbi Lietuvos Respublikos Konstitucinio Teismo, kuriam patikėta mūsų valstybės Konstitucijos oficialaus aiškinimo misija, jurisprudencija. Konstitucijos aiškinimą (konstitucinę interpretaciją) traktuosime ne kaip mechaninį teisinio aiškinimo metodų taikymą, bet kaip vientisą procesą, kuriame regime aiškinimo strategijos pasirinkimą, su tos strategijos įgyvendinimu susietų teisinio aiškinimo metodų, technikų ar taisyklių derinių panaudojimą ir gautus tokio aiškinimo rezultatus. Straipsnyje pabrėžiamas konstitucijos aiškinimo strategijos ypatingumas – Lietuvos Respublikos Konstitucinis Teismas ją traktuoja kaip teisiškumo etaloną, įstatymų ir kitų ordinarinės teisės aktų tikrinimo matą ir jos nuostatas aiškina kaip tobulą, darnią teisę. Konstitucinio teksto ypatumai, jos normatyvinės dimensijos (normos ir principai, o tarp pastarųjų – ir nepakeičiami pamatiniai principai) sudėtingumas, konstitucinių vertybių sistemos, konstitucijos kaip teisės be spragų koncepcijos atskleidimas reikalauja taikyti pačius įvairiausius teisinio aiškinimo metodus, principus, technikas ar taisykles, galinčias atskleisti minėtus aspektus. Aiškinant konstituciją reikia ne tik taikyti įvairius teisės aiškinimo metodus (sisteminį, bendrųjų teisės principų, loginį, teleologinį, teisės kūrėjo ketinimų, precedentų, istorinį, lyginamąjį ir kt.), bet prireikus juos papildyti naujais aiškinimo kriterijais, elementais ar taisyklėmis, adaptuoti įprastinius (tradicinius) teisinio aiškinimo metodus ar išryškinti tam tikrus jų aspektus, kad geriau atsiskleistų konstitucinė norminė tikrovė, naudoti tradicinių ir naujai išryškėjusių kriterijų kombinacijas. Konstitucijos kaip vertybių sistemos samprata siejama su pagrindinių teisių apsauga, konstitucinių vertybių pusiausvyros užtikrinimo klausimais, konstitucinės kontrolės instituto funkcionavimu. Konstitucijos aiškinimas grindžiamas konstitucinio akto nuostatų ir šiuolaikine vertybių samprata. Visi teisę kuriantys ir ją taikantys subjektai savo aktus ir sprendimus turi suderinti su konstitucija ir ją atskleidžiančia oficialia konstitucine doktrina, darančią poveikį visai teisinei sistemai. Atitiktis konstitucijai yra bet kokio teisės akto teisinio veikimo sąlyga. Konstitucijos aiškinimas – teisinis aiškinimas, tačiau jo ypatumai leidžia tokį aiškinimą traktuoti kaip specifinį, turintį savitų bruožų teisinio aiškinimo atvejį.
The article examines the issue of the specificity of constitutional interpretation, which constantly arises in the science of constitutional law. According to some authors, the interpretations of the constitution and laws and other ordinary legal acts differ, i.e., they see the specificity or particularities of the interpretation of the constitution. Meanwhile, other authors tend to believe that there is no major difference between those interpretations or that those differences are only of a quantitative nature. Among the constitutionalists who support the latter view today, typical arguments for this group have been set out by R. Guastini, M. Luciani and D. A. Celis Vela. We will follow the following path of research: first, we will discuss the claims of those who deny the specificity of the interpretation of the constitution, and then we will clarify whether the specificity of the constitution, the country‘s highest primary founding law, determines one or another specificity of its interpretation. From this point of view, the jurisprudence of the Constitutional Court of the Republic of Lithuania, which is entrusted with the mission of official interpretation of the Constitution, is important to us. We will treat the interpretation of the Constitution (constitutional interpretation) not as a mechanical application of legal interpretation methods, but as a unified process, in which we see the choice of an interpretation strategy, the use of combinations of legal interpretation methods, techniques or rules associated with the implementation of that strategy, and the results of such interpretation. The article emphasizes the uniqueness of the interpretation strategy of the Constitution - the Constitutional Court treats the Constitution as a standard of legality, a measure of verification of laws and other ordinary legal acts and interprets constitutional provisions as a perfect, harmonious law. The particularities of the constitutional text, the complexity of its normative dimension (norms and principles, and among the latter, irreplaceable fundamental principles), the disclosure of the system of constitutional values, the concept of the constitution as law without gaps require the application of various methods, techniques or rules of legal interpretation that can comprehensively reveal the aforementioned aspects. When interpreting the constitution, it is necessary not only to apply various methods of legal interpretation (systemic, general principles of law, logical, teleological, intentions of the lawmaker, precedents, historical, comparative, etc.), but also, if necessary, to supplement them with new interpretation criteria, elements or rules, to adapt conventional (traditional) methods of legal interpretation or to highlight certain aspects of them in order to more fully reveal the constitutional normative reality, to use combinations of traditional and newly emerged criteria. The concept of the Constitution as a system of values is associated with the protection of fundamental rights, issues of ensuring the balance of constitutional values, and the functioning of the institute of constitutional control. The interpretation of the Constitution is based on the disclosure of the provisions of the constitutional act and the modern concept of values. All subjects creating and applying law must harmonize their acts and decisions with the Constitution and the official constitutional doctrine revealed by it, and the official constitutional doctrine affects the entire legal system. Compliance with the constitution is a condition for the legal effect of any legal act. The interpretation of the constitution is a legal interpretation, but its particularities allow such an interpretation to be treated as a specific case of legal interpretation with its own characteristics.
